Washington DC - Supreme Court Considers Legality of Obamacare

Coltons Point - People's Court Considers Insanity of Obamacare


The US Supreme Court is listening to an unprecedented 6 hours of debate over the  Constitutionality of Obama's health care program.  It is another face off of biblical proportions between David and Goliath with the all powerful US Attorney General representing President Obama and a group of State Attorney Generals representing state's rights and the people.

The classic confrontation between a strong central government versus a division of authority between states and the federal government.


Federalism versus decentralize government.

More loss of individual freedom versus the government's right to control you.

Boy did we ever need this Supreme Court action in the middle of a presidential election, as if we didn't have enough problems with the staggering economy, the confused foreign policy and the breakdown of morality in government, in most institutions, and in life.


So I say the Supreme Court should declare the whole thing unconstitutional on the grounds:

The name alone is just plain deceptive or stupid.  This is the legal name of Obamacare, the health care reform program, "Health Care and Education Reconciliation Act of 2010 (H.R. 4872)".

Does that say anything about improving medical services, lowering medical costs, eliminating fraud, corruption, conflicts of interests, bribes or kickbacks rampant in the health care industry?


Before we adopt some smorgasbord of medical regulations that will increase the already too high cost of medical care and health insurance don't we need answers to a few questions?

1. Should the government be doing this?

2. Why do we stay sick if we can get well?

3. Will it bring down the spiraling cost of medical care and prescription drugs?

4. Will it help strengthen the body and make it self-sustaining?

5. Will it make the best use of medical knowledge learned throughout time?

6. Does it give incentives to make people well rather than keep them sick?

7. Does it eliminate the conflicts, fraud, corruption and abuse in the industry?

None of this is really addressed in the Obamacare or any other health care program of the government, proposed by the government or even being considered by the government.


Therefore the judgment of the People's Court should be Rejection of the program on the grounds of Insanity, and rejection of the arguments both for and against Obamacare as neither is relevant to the desperate wellness, health care and anti-corruption needs of the people of America.

The Supreme Court would do well to adopt a similar ruling.

Supreme Court rules "Sexually Dangerous" Prisoners can be kept out of Society!

In a landmark 7-2 decision, the justices declared that a federal law allowing federal prisoners deemed "sexually dangerous" to be held even after they have served out their original sentences is constitutional.

The Court said Congress does have the power to keep such dangerous offenders out of society indefinitely.

Justice Clarence Thomas dissented arguing that Congress went too far, and nothing in the Constitution permits this kind of extended confinement.

Re•cid•i•vism is defined as a tendency to relapse into a previous condition or mode of behavior; especially : relapse into criminal behavior. Back in the 1970's I was involved in a study by the Federal Bureau of Prisons to review the behavior of federal criminals and the impact of rehabilitation on the recidivism rates of various types of crime.

At the time there was debate as to what types of crimes could be rehabilitated and whether certain types of criminal behavior like sexual predators, abusers and rapists who repeated crimes when released from prison could ever fit the mold of a criminal who paid their debt to society and could be rehabilitated.



I was among the advocates that certain criminals were possessed by evil, like a genetic coding, and no form of incarceration would result in reforming the warped mind of the abuser. They would be a threat to society every time they left jail and the only viable and safe solution for protecting Americans was to keep these demented criminals out of society permanently.

This could only be accomplished through life terms without parole or a special status that gave law enforcement the right to have them permanently imprisoned regardless of the sentence handed down by the courts. Over the years thousands of Americans, especially women and children, have been murdered and many thousands more permanently scarred psychologically by being victims to these heinous predators.



In areas where serial predators roamed fear was widespread and affected the quality of life of all people who lived by the law.

This ruling denies no one due process as those who will be designated as "sexually dangerous" have had numerous opportunities to avoid such a fate or have been so evil as to demonstrate they cannot exist in a society of laws. Too often judges have refused to impose maximum prison sentences or the states have not made the sentences long enough for repeat offenders of particularly vicious crimes.

It is a long overdue ruling to recognize that the argument "cruel and unusual punishment" does not apply to those who repeatedly deny other people the right to a life free from sexual predators. The fact both liberal and conservative Supreme Court justices agreed is a major victory for the people.

Supreme Court nominee Elena Kagan Can Bat Clean Up For Me Any Day

.


Now this is not what we normally expect of a nominee for Supreme Court justice, to be pictured playing softball, so this photo created a little controversy. Like the idiots they are, some media said this photo of Supreme Court nominee Kagan meant she was gay.



I, as a male and coach of several championship women's softball teams in New Jersey and Nebraska, say they are nuts. The only thing this photo tells is that she enjoys being part of American's favorite past time for all the would be major league baseball stars who got old before they were stars.





If baseball is America's favorite past time, then softball is where all good baseball players go if they don't make the big leagues. Kagan playing softball does not make her gay, it just shows she enjoys the most popular participation sport in America.



Just like Jennie Finch, probably the greatest American women's softball pitcher in history who led the USA to world dominance. Of course that was after she led my old school, the University of Arizona, to national fame. Out of uniform she looks pretty good.



Softball is as American as apple pie. Check out all the celebrities from Carrie Underwood to Queen Latifah who play to help raise money for worthy causes. If anything, the photo of Kagan shows she is probably a darn good softball player, the kind I recruited for my teams.





That makes her a bit more in touch with us humans and even more needed on the Supreme Court. It is also just another sign that the media is so out of touch it no longer serves a viable purpose in America.





By the way, the following body flying through the air is little Shawn Johnson of Olympic gymnastics fame and a fellow native of Iowa. She also enjoys a good game of softball.

Obama Hijacks Palin Agenda for Born Again Populist Pitch

Obama talks for 70 minutes, people are still not sure what he said. But he did smile a lot, tell a few jokes, lecture the public, scold the Supreme Court, castigate an inept Congress and hijacked a bunch of Sarah Palin's agenda that he condemned so viciously last year.

So now, will the liberal elite who buried Palin in insults and smears claiming she was too inexperienced to be babysitter let alone president when she was really running for vice president, now apologize to her since the Chosen One has now seen the light and co-opted her platform and that of the Tea Party? Why he didn't even credit the source of the ideas.



Off shore oil drilling, business tax credits, eliminate capital gains taxes, hiring credits, more nuclear plants, coal and natural gas production, he used a whole lot of the Palin platform to try and win back the independents and people who expect government to be competent. You don't think it has anything to do with the polls do you?



Just so you know he was not completely out of form, as the original Obama was quite the entertaining speaker, he did point out that recent letters he has received from people tell him of the suffering and pain Americans feel about jobs, housing, healthcare and education. You would think after campaigning for president for two years and being president for one year he would have known how bad people were suffering but at least he reads the mail.



Did he hear anything the people told him? Guess not as he said the anti-Washington feeling sweeping across the nation and sweeping politicians out of office was the same wave he rode on his surfboard. I don't think so Mr. Obama. How in the world could someone with all the experience you had as United States Senator and community organizer make you an outsider? Anyone mistaking Obama for anything but a Washington insider would be the same people who mistake Bambi for a serial killer.

Anyway his long and often used "outsider" pivot is another area where he ripped off Sarah Palin who really was an outsider and did fight the political establishment. Heck, Obama even made reference to the bank bailout being like a root canal. Does that mean he ripped off Palin once again with her "drill baby drill" mantra during the campaign? After all the flip flops and absconding of Palin's agenda and platform he would have been a lot better off to have had Palin as VP and kept Biden in the doghouse.



Okay, then there were the 66 references to the almighty "I", another consistent Obama trait that leaves one wondering if the virtue of humility has any place in our young president's worldview. I'm beginning to think he has no foundation to his worldview but snatches the last argument he heard about what to think, whether it came from Sarah Palin or South Park. Then he throws out all he stood for in the campaign which seems to upset those liberal groups expecting socialism to already be here.



Did Obama pivot on his policies like he did his Palinesque rhetoric? Let's see. He still wants his health care bill, cap and trade legislation, pending jobs bill, maybe another similar stimulus since the first one did not do what he wanted, and he now has better ideas for the Tarp funds repaid by the big, bad banks. One might have thought the bank payments would go to reduce the deficit but not our president.



Overall there is one difference between what Obama proposes and what Palin, the Republicans or the Tea Party people would want. I'm sorry Mr. President but you are not the poster boy for the Tea Party and you are most certainly not the Washington outsider you claim. You made the deals to bailout out the banks, insurance companies, auto companies and save the unions and Goldman Sachs from huge losses for irresponsible investing.



You along with most of the politicians in Washington take the money from the lobbyists, banks, insurance companies and every other group like trial lawyers and pharmaceuticals and stick it in your campaign coffers. Some outsider. If you could just tell us the truth and say you will stop being a politician we might believe you. But you act as if you are disgusted by the very practices you encourage behind the scenes and behind closed doors. Where I come from that is being a hypocrite.



Beyond the rhetoric and entertainment there were a couple of ominous signs that would scare the hell out of any God fearing, patriotic American but our adoring media seemed to not notice, and they all too often seem to not notice when Obama makes no sense. This time he made sense.

First he threatened Congress when he said if they didn't give him a bill he wanted he would just sign an executive order and eliminate the need for Congress to act. So the Executive branch can eliminate the need for the Legislative branch to perform their duty. It has already happened under Obama with the cap and trade fiasco demonstrating a distain for such Constitutional principles like the separation of powers and checks and balances between the Executive and Legislative branches.



The House passed the Al Gore/Goldman Sachs cap and trade carbon emissions retirement bill but the Senate wants to think about it, so it spins in the wind doing nothing while others investigate it. Obama's Environmental Protection Agency then decides it knows how to cut Congress out of the decision by declaring carbon dioxide a toxic gas thus making it subject to federal regulation with no action by Congress. One again the Administration has demonstrated a disregard for the Constitutional separation of powers between the Executive and Legislative branches.

My advice to EPA is to go out and arrest all the trees of the world because they emit carbon dioxide when they are cut down. Forget about the fact they also absorb nearly 40% of all carbon dioxide through their natural photosynthesis process. Arrest all the people burning wood for heat because they are directly polluting our atmosphere. And arrest the oceans while they are at it because the sea both generates carbon dioxide and absorbs it to the tune of 60% of all emissions.



The Obama Administration disregard for our Constitutional protections, ones which our forefathers warned us about, is quite disturbing. Why do they think they can ignore elements of the Constitution that guarantee the separation of powers and assure the checks and balances between each division of our republic? Not content with ignoring the separation of powers with the Legislature, he then took aim at the third division of government, the Judiciary.

He scolded the Supreme Court, condemning their decision on corporate free speech, and seemed to try and embarrass them as they sat in the front row watching his speech. One was visibly upset, not by the criticism but by the fact Obama did not even tell the truth about the decision. Obama said the court action will allow corporations, including foreign corporations, to own the US election process. Well foreign corporations are prohibited from contributing to our campaigns and the Supreme Court decision had nothing to do with that.



Obama also forgot to mention he and the Democrats already have taken millions of dollars from corporate executives while the political parties take money directly. He also forgot to mention that anytime Obama and Congress want to fix the system of campaign financing they can do it if they have the guts. However, corporations are betting millions that Obama and our political leaders in the capitol will do nothing.

The thought that a president thinks he can ignore the Constitution if the Legislature and the Judiciary fail to do his bidding is very scary. Finally, his criticism of both parties for not doing what he wanted is a joke as he was the one who refused to work with both parties choosing to work directly with the lobbyists of the special interests. His approach resulted in a new meaning for pork barrel as he gave away $60 billion to the unions without Congressional approval, tens of millions of dollars to the people of Nebraska and Louisiana to bribe their Senators, and billions in protection to the pharmaceutical companies.



Well, he can say what he wants but it sure seems to me as if politics as usual is alive and well in the back rooms of our nation's capitol from the White House to the Halls of Congress. Don't be fooled by the rhetoric. Don't be fooled by the pivots. Don't be fooled by the new found or born again populism. No one in Washington, including our Ivy League educated president, is a friend of the people over special interests or Wall Street.

Tweedledee and Tweedledum - 48 Hours after Massachusetts both Parties Double Cross Public

In a stunning reaction to the Supreme Court ruling on campaign finances, both Democrats and Republicans seem to be suffering short term memory loss from the Massachusetts Senate debacle and they immediately took the most hypocritical and self-destructive positions possible. One thinks the American public knew this was coming, just more of the same politics as usual.

As for the lesson at the Boston Tea Party last Tuesday night, it fell on deaf ears in the White House and in both political party caucuses in the House and Senate. People are fed up with politics as usual. The Wednesday morning after the election Obama, Reid, Pelosi and the Republicans all said they recognized the angry mood of the public.



By Thursday both parties hoped the public would remember what they said Wednesday and forget what they had said before Wednesday. Thursday both had returned to vintage form in responding to the Supreme Court decision regarding campaign finance. You need a daily scorecard to keep track of how many times they change positions per day.

Obama led the Democrats in condemning the Supreme Court decision saying it opened the floodgates to corporate financing of candidates. Duh... As reported before, Obama and the Democrats are the chief beneficiary of corporate money in campaigns. They also failed to mention the unions were also given carte blanc to buy politicians by the Supreme Court. So the Democrats double crossed the public less than 48 hours after the campaign catastrophe in Boston.



How about the new found populist element of the Republican party? Well they double crossed the public in the same 48 hour period when they reacted to the Supreme Court ruling by saying it restored free speech in America or it puts media corporations and the rest of corporate America on the same footing. Either way it means the same thing, they supported the decision.



Both political party bosses and our young president sank back into the old world of politics before the ink even dried on the stories of how they learned their lesson in Massachusetts. My goodness, the mental institutions are filled with people with multiple personalities, self-destructive psychosis and subliminal paranoia.

Get out the straight jackets and move over patients, we have 539 politicians, (437 House, 100 Senate and 2 in White House - Obama & Biden) in need of a heavy dose of America's favorite cocktail, Prozac, or kid's drink, Ritalin, a straight jacket and a few years to sleep off their attack of sheer idiocy.



Obama, the Democrats and Republicans are all addicted to corporate and union money and all share in the spoils of hundreds of millions of dollars being poured into campaigns by special interests who own our elected leaders. Do not express your dismay, shock or approval in press conferences while you are stuffing your campaign accounts with money from these bad guys.



Any politician who takes the money or support from such dirty money should admit their deception immediately and give back the bucks or be thrown on the scrap heap of history. Untruth still rules our nation's capitol and the Non-political Independent movement that has already plowed through Virginia, New Jersey and Massachusetts the last few weeks can take aim at the rest of the gang in DC and keep on house cleaning.



We will continue reporting on the hypocrisy as long as the lies and cover ups keep flowing from the mouths of the guilty in Washington. Keep it up people, we have a lot of straight jackets to fill. In the meantime responsible public officials will eliminate private financing of campaigns, make corporate and union contributions of any kind illegal, provide limited public financing and require media to give ads to viable candidates. It does not take a rocket scientist to figure out how to eliminate corruption, just an honest president and congress.

Supreme Court Knocks Down Corporate & Union Spending Limits - Time to Get Rid of All Special Interest Bribes

In a stunning decision the US Supreme Court knocked down the federal limits on non-candidate spending in campaigns. What this means is there is no limit to the money corporations or unions can spend in support of federal candidates for office as long as they don't give it directly to the candidates. The current spending limits on campaign contributions will remain.



Now we will see if our Congress and President intend to work for the people or for special interests. If they have heard the disgust of the people toward current campaign spending and special interest influence they will find a way to stop all corporate and union contributions and expenditures for campaigns on the grounds that it will protect the integrity of campaigns.



A ban on all contributions in the interest of fairness and assuring equal opportunity to get elected would go a long ways toward cleaning out the mess Congress has made of campaign finance laws. This action by the Supreme Court though stunning in throwing the door open to millions more in special interest money, also will demonstrate once and for all which elected officials serve the public and which serve special interests.



You will be kept informed of those that are for and against the people and the revolution of getting rid of politics as usual will have a daunting task ahead, purging our nation's capitol of corruption once and for all. Watch for campaign reform actions. If there are none then they are all crooks.

Sotomayor to be First Latin Supreme Court Justice

Sonia Sotomayor will become the first Latino and only the third woman to serve on the US Supreme Court when the US Senate confirms her nomination in the next few days. In spite of media efforts to say the Republicans are trying to stop the nomination, there is no evidence they are going to do it.





In fact Senator Lindsey Graham, a Republican, has vaulted into the national spotlight with his most thoughtful questioning in Committee hearings on the nomination. Graham is the only person to question her so far who did not work from a script intended to highlight her strengths or weaknesses depending on whether you are a democrat or republican. Graham talked with her about honest questions regarding her previous statements, speeches and rulings.





Sotomayor, of Puerto Rican descent and a lifelong New Yorker from the Bronx, would be the only person on the Supreme Court with trial experience in addition to being a federal judge and in spite of some very strange statements she made some time ago. In the end she will be confirmed because we need a Latino on our highest court and she does have the necessary credentials.
